dc.description.abstract | Στη σύγχρονη κοινοβουλευτική δημοκρατία, η αντιπολίτευση ελέγχει την κυβέρνηση για τις πράξεις και τις παραλείψεις της και, παράλληλα, προβάλει τις προτάσεις της για τα προβλήματα της χώρας επιχειρώντας να πείσει την κοινή γνώμη γι’ αυτές και να μεταβάλλει τον πολιτικό συσχετισμό δυνάμεων. Παράλληλα, καλείται από το συνταγματικό πλαίσιο σε ορισμένες αποφάσεις για τις οποίες απαιτούνται επαυξημένες πλειοψηφίες, να αναζητήσει από κοινού με τη συμπολίτευση τη δυνατότητα συναίνεσης.
Στην Ελλάδα, το μεταπολιτευτικό θεσμικό πλαίσιο παρέχει στην αντιπολίτευση τα ακόλουθα εργαλεία:
• Για τον έλεγχο της κυβέρνησης: τα μέσα κοινοβουλευτικού ελέγχου, περιλαμβανομένου και αυτού της υποβολής πρότασης δυσπιστίας και τη δυνατότητα υποβολής προτάσεων για τη σύσταση εξεταστικών και των λεγόμενων προανακριτικών επιτροπών,
• Για την προβολή των προτάσεών της: την κατάθεση προτάσεων νόμου και τη διεξαγωγή συζητήσεων προ ημερησίας διατάξεως.
Παράλληλα, τα πεδία, όπου η πρόβλεψη αυξημένης πλειοψηφίας από το Σύνταγμα δίνει τη δυνατότητα στην αντιπολίτευση να συμμετάσχει καθοριστικά στην λήψη ορισμένων αποφάσεων, είναι τα εξής: η αναθεώρηση του Συντάγματος, η εκλογή Προέδρου της Δημοκρατίας, η μεταβολή του εκλογικού συστήματος και η επιλογή της ηγεσίας των συνταγματικά κατοχυρωμένων Ανεξάρτητων Αρχών στο πλαίσιο της Διάσκεψης των Προέδρων.
Η μελέτη αυτή, εξετάζει τα εν λόγω «εργαλεία» και τα πεδία εν δυνάμει συναίνεσης, παρουσιάζει την ιστορική εξέλιξη του ρυθμιστικού πλαισίου τους και την πρακτική εφαρμογή τους, αναφέρεται στις προσεγγίσεις που έχουν υιοθετηθεί σε αλλοδαπά πολιτικά συστήματα και τέλος αξιολογεί το σημερινό θεσμικό τους πλαίσιο και την πολιτική σημασία τους.
Το βασικό συμπέρασμα που συνάγεται είναι ότι μολονότι το θεσμικό πλαίσιο, και συγκεκριμένα το Σύνταγμα και ο Κανονισμός της Βουλής έχουν εξελιχθεί κατά τρόπο που διευρύνει τη δυνατότητα της αντιπολίτευσης να επιτελέσει τη λειτουργία της, ωστόσο εξακολουθούν να υπάρχουν σημαντικές θεσμικές αστοχίες, αλλά και πολιτικές στρεβλώσεις. Έτσι, η αντιπολίτευση: α) δεν μπορεί να ασκήσει αποτελεσματικό κοινοβουλευτικό έλεγχο, β) δεν μπορεί και σε ένα βαθμό δεν επιδιώκει να προβάλλει εναλλακτικές προτάσεις και γ) τόσο αυτή όσο και η συμπολίτευση δεν ανταποκρίνονται στη συνταγματική πρόκληση για συναίνεση εκεί που απαιτείται αυξημένη πλειοψηφία.
Τα προβλήματα δεν οφείλονται αποκλειστικά στο θεσμικό πλαίσιο αλλά εξ ίσου και στην πρακτική των πολιτικών δυνάμεων, και η διατριβή αυτή κάνει αυτή την κρίσιμη διάκριση σε κάθε κεφάλαιο.
Σε ό,τι αφορά τις θεσμικές αστοχίες, είναι αναγκαίο να βελτιωθούν οι ρυθμίσεις του Συντάγματος και του Κανονισμού της Βουλής προς την κατεύθυνση αφενός της διευκόλυνσης του ελέγχου και της προβολής των θέσεων της αντιπολίτευσης και αφετέρου της κατάργησης των περιθωρίων καταστρατήγησης των συνταγματικών ρυθμίσεων που αποβαίνουν σε βάρος της ομαλής λειτουργίας του πολιτεύματος. Η μελέτη προτείνει αυτές τις αναγκαίες βελτιώσεις του θεσμικού πλαισίου και παράλληλα εξηγεί γιατί θα είχε προστιθέμενη αξία η κλιμάκωση αυτών των θεσμικών βελτιώσεων με την αναγνώριση σε επίπεδο Συντάγματος της αντιπολίτευσης ως βασικού θεσμού του πολιτεύματος.
Από την άλλη πλευρά, όπου τα προβλήματα οφείλονται στην πολιτική πρακτική, το κύριο ζητούμενο είναι να γίνει αντιληπτό ότι η λύση γι’ αυτά δεν εντοπίζεται σε μια αβασάνιστη και συχνά επικίνδυνη αλλαγή του θεσμικού πλαισίου αλλά στη συνειδητοποίηση της ανάγκης για αλλαγή της συμπεριφοράς των κομμάτων είτε βρίσκονται στη συμπολίτευση είτε στην αντιπολίτευση.
Η αναζήτηση θεσμικών βελτιώσεων και η συνειδητοποίηση των παθογενειών της πολιτικής ζωής και κουλτούρας στη χώρα μας καθίστανται περισσότερο παρά ποτέ αναγκαίες στη σημερινή Ελλάδα όπου μια σειρά από παράγοντες υπονομεύουν την εμπιστοσύνη των πολιτών προς την αποτελεσματική λειτουργία του κοινοβουλευτικού πολιτεύματος, εξέλιξη που μπορεί να έχει σοβαρές συνέπειες στο μέλλον. | el |

dc.description.abstracttranslated | In modern parliamentary democracy, opposition controls the government for its acts and omissions and, at the same time, publicizes its proposals for the country’s problems in an effort to convince the public opinion and change the political landscape. Furthermore, it is called upon by the constitution, in certain decisions where special majorities are required, to search along with the majority the possibility for consensus.
In post dictatorship Greece, the institutional framework provides to the opposition with the following “tools”:
• For controlling the government: the process of parliamentary scrutiny including the censure against the government and the right to ask for the creation of inquiry commissions as well as commissions for the investigation of ministers’ possible criminal activity,
• For communicating its proposals: the process of submitting draft laws and the debates at the level of political leaders.
At the same time, the fields in which the opposition has an important role in the decision-making process because of the constitutionally required special majorities, are the following: revision of the Constitution, election of the President of the Republic, change of the electoral system and selection of the leadership of the independent authorities by the relevant parliamentary committee.
The study examines the above “tools” for opposition and the fields for possible consensus, the evolution over time for the relevant legal framework and the political practice, the approaches adopted by other countries time and, finally, evaluates the legal framework and the political importance of each one.
The main conclusion is that, overall, the legal framework has developed in a way which broadens the opposition’s opportunity to realize its role but there are important institutional deficiencies and political distortions. As a result, the parliamentary opposition (a) cannot fully exercise efficiently its control mission and (b) cannot –and to some extent does not seek to- present its alternative proposals. Finally, both the majority and the opposition do not stand up to the constitutional challenge for consensus where increased majorities are required.
These problems are not exclusively due to the legal framework but to the practice of the political forces as well and the study makes this distinction in each case.
The problems concerning the legal framework must be addressed, on the one hand, by facilitating the control function of the opposition and its ability to present its proposals and, on the other, by eliminating the possibilities –wherever they exist- of abusing the constitutional provisions to the determined of the normal functioning of the political system. The thesis presents the required changes and, at the same time, explains why it would have certain added practical and symbolic value to expressly recognize in the constitution the parliamentary opposition as an institution of the polity.
On the other hand, it must be realized that the problems which are owed to the actual political practice cannot be solved by superficial and dangerous changes in the legal framework; they should rather be tackled by realizing that the real problem is political and not legal and that it is the behavior of the political parties, whether in government or in oppositions, which has to change.
Seeking a better legal framework and realizing the problems created by political practice are now more important than ever in modern Greece where a number of factors undermine the citizens’ confidence to the effective functioning of the parliamentary system, something which may have serious consequences in the future. | el |
