Η πυραμιδοειδής οργάνωση και ρύθμιση του αθλητισμού υποχρεώνει τον αθλητή να παρέχει τις υπηρεσίες του υπό όρους a priori καθορισμένους, μην αφήνοντας στον αθλητή περιθώρια διαπραγμάτευσής. Αν και οι ομοσπονδίες δεν αποτελούν τον εργοδότη των αθλητών αλλά καθορίζουν τους όρους εργασίας των αθλητών είτε μέσω των καταστατικών τους είτε μέσω ρητών οδηγιών είτε μέσω της επιρροής που ασκούν στα σωματεία, τα οποία με τη σειρά τους συνάπτουν συμβόλαια με του αθλητές. Ιδίως σε διεθνές επίπεδο τίθενται περιορισμοί στην περαιτέρω οικονομική αλλά και ιδιωτική ζωή των αθλητών, μέσω προέγκρισης οικονομικών συμφωνιών των αθλητών αλλά και επιβάλλοντας ρήτρες χρηστής συμπεριφοράς. Μέσω του νόμου 2725/1999 ο νομικός χαρακτηρισμός της σχέσης του αθλητή με την ομάδα του προκαθορίζεται. Επιπλέον, γίνεται ένας διαχωρισμός σε επαγγελματίες/ αμειβόμενους αθλητές και σε ερασιτέχνες αθλητές, ο οποίος μέσω της κρατούσας νομολογίας, έχει καταστεί κανόνας αναγκαστικού δικαίου, αφού δεν εξετάζει τις σχέσεις αυτές κατά περίπτωση. Αυτός ο τυπικός διαχωρισμός αποστερεί το σύνολο των αθλητριών και το μεγαλύτερο ποσοστό των αθλητών που αγωνίζονται στην Εθνική Ομάδα, χωρίς την προστασία του εργατικού δικαίου. Στερούνται συνταγματικά απονεμόμενα δικαιώματα, χάριν της βιωσιμότητας των σωματείων, μην έχοντας συχνά τη δυνατότητα να επιλέξουν το πρόσωπο του εργοδότη τους ή ακόμα και τον τόπο παροχής των υπηρεσιών τους λόγω περιορισμών στη δυνατότητα μετεγγραφής τους. Διαφαίνεται ωστόσο η ανάγκη αλλαγής και προσαρμογής του νομοθετικού τοπίου. Μέσω σχέδιου νόμου η Ελλάδα προσπαθεί να εναρμονιστεί με τις αποφάσεις του ΔΕΕ αλλά και με την επιταγή του Συντάγματος για προστασία του ατομικού δικαιώματος στην εργασία. Περιορισμοί της οικονομικής ελευθερίας των αθλητών παρατηρούνται ωστόσο και σε συμβόλαια sponsoring. Ρήτρες αποκλειστικότητας και χρηστής συμπεριφοράς αποτελούν παγιωμένο περιεχόμενο όλων των συμβάσεων sponsoring. Αντικείμενο έντονων ρήξεων αποτελεί η ερμηνεία του όρου “ευπρεπής συμπεριφορά”.
Abstract
The pyramid like way of organization and regulation of sport obliges the athlete to provide his services on a priori set terms. Therefore the athlete doesn’t have the leverage to negotiate. Although the federations are not the employer of the athletes, they do define the working conditions of the athletes either through their regulations or through explicit instructions or through the influence they exercise on the teams, which in turn sign contracts with athletes. Particularly on an international level, they restrict the athletes' further economic and private life through mandatory approval of sports agreements by athletes and by imposing moral clauses. The Law 2725/1999 the legal classification of the athlete's relationship with his team is predetermined. In addition, a distinction is made between professional / paid athletes and amateur athletes, which has become a mandatory rule by existing jurisprudence, since it does not examine these relationships on a case-by-case basis. This typical segregation leaves all women athletes and the majority of athletes who compete in the National Team without the protection of labor law. Constitutionally granted rights are maintained for the sake of the viability of the teams, as they often do not have the opportunity to choose their employer or even the place where they provide their services due to restrictions on their transfers. However, the need to change and adapt the legislative framework prevails. Through the draft law, Greece is trying to align itself with ECJ rulings as well as with the Constitution's requirement to protect the individual right to work. Restrictions on the financial freedom of athletes are also observed in sponsorships. The clauses of exclusivity and moral conduct are typical in all sponsorship contracts. The interpretation of a moral clause is often a matter of dispute.
