| dc.description.abstract | Ο Συμπαραστάτης του Δημότη και της Επιχειρήσεως, συμμετοχικός διαμεσολαβητικός θεσμός υπαγορευθείς υπό της Συνθήκης της Λισαβόνας και εισαχθείς στο ελληνικό δίκαιο δια του άρθρου 77 Ν. 3852/2010, πρόσωπο "εγνωσμένου κύρους και εμπειρίας", επιλέγεται και ανακαλείται δια της αυξημένης πλειοψηφίας των 3/5 των παρόντων μελών του Δημοτικού Συμβουλίου, στους ηπειρωτικούς Δήμους με πληθυσμό άνω των 20.000 κατοίκων και στους νησιωτικούς Δήμους. Δεν ανήκει αλλά κινείται παραπλεύρως της διοικητικής ιεραρχίας, απολαμβάνων πλήρους προσωπικής και λειτουργικής ανεξαρτησίας. Διερευνά τις καταγγελίες δημοτών / επιχειρήσεων αναφορικώς σε περιπτώσεις ευθείας παρανομίας και (κυρίως) κακοδιοικήσεως υπό της δημοτικής αρχής / δημοτικής υπηρεσίας και ασκεί έμμεσο εσωτερικό έλεγχο και διαμεσολαβητική λειτουργία μεταξύ καταγγέλλοντος και καταγγελλομένου. Απευθύνει ειδικές προτάσεις προς τον Δήμαρχο και συντάσσει και υποβάλλει ετήσια έκθεση ενώπιον του Δημοτικού Συμβουλίου. Δι' αυτού σκοπείται η διατήρηση και ενίσχυση των αρχών της εγγύτητας, της επικουρικότητας, της συμμετοχικής δημοκρατίας, της διαφανείας, της λογοδοσίας και της χρηστής διοικήσεως. Αντιρρόπως προς την διεθνώς και πανευρωπαϊκώς παρατηρούμενη "Ombudsmania", στην Ελλάδα ο θεσμός εμφανίζει ελαφρά υποχώρηση, καθώς σήμερα έχουν επιλεγεί και υπηρετούν τριάκοντα τέσσερεις (34) (επί δυνητικού συνόλου διακοσίων τριάκοντα τεσσάρων [234]) Συμπαραστάτες του Δημότη και της Επιχειρήσεως. | el |

| dc.description.abstracttranslated | The Supporter of the Citizen and the Business (Local / Municipal Ombudsman), a participatory mediation institution dictated by the Treaty of Lisbon and introduced into Greek law by article 77 L. 3852/2010, a person of "known prestige and experience" but not an elected municipal or regional representative or a member of the Greek Parliament, is selected and recalled by an increased majority of 3/5 of the present members of the Municipal Council, in the mainland Municipalities with a population of over 20,000 inhabitants and in the island Municipalities regardless of population. Nowadays, 34 (out of a potential total of 234) Supporters of the Citizen and the Business have been selected and serve (24 lawyers and 10 of other professions, 24 men and 10 women). He / she aims to fight maladministration (which has several causes and types) and to maintain and strengthen the principles of proximity, subsidiarity, participatory democracy, transparency, accountability and good administration. He / she does not belong but moves alongside the administrative hierarchy, enjoying full personal and functional independence. He / she receives a remuneration equal to that of the President of the Municipal Council. He / she resides in an independent office. He / she investigates the complaints of having direct legal interest citizens / businesses regarding cases of direct illegality and (mainly) maladministration by the municipal authority / municipal service and exercises indirect internal control and mediation function between the complainant and the defendant. He / she follows a flexible but always written procedure, without producing judgements. He / she addresses specified proposals to the Mayor and prepares and submits an annual report before the Municipal Council. He / she relates in several ways to the Municipal Council, the Municipal Authority, the Local Councils, the Quality of Life Committe, the Financial Committe, the Municipal Consultation Committee and the Immigrant Integration Council. He / she appears certain similarities and differences to the Decentralized Administration, the Regional Supporter of the Citizen and the Business, the Civil Society and the Advocate of the Citizen. The institution varies regarding the country, extending even to the protection of basic human rights. To elaborate this dissertation primary Greek and foreign language bibliographic, article and internet reports and primary research material (questionnaire answers and annual reports) were used, from which it was found that a) the municipal authority either does not trust or does not give due importance to the institution, b) several legislative amendments are required to secure and defend the institution, c) it is necessary to promote and communicate the institution to the municipal authority, the municipal services, citizens and businesses, d) the institution already contributes and can contribute further positively in most areas of public policy at local level, in sustainable development, in the legacy of intangible goods, in the intra-administrative operation of the Local Government and in the "fluid society" of the age of "reflective modernization" and e) in contrast to the international and european "Ombudsmania", in Greece, where there are mostly structural and budgetary problems, the institution shows a slight decline. | el |
