Η μετανάστευση συνιστά ένα κοινωνικό φαινόμενο με σημαντικό αντίκτυπο. Οι ισορροπίες μεταβάλλονται, καθώς οι χώρες που κατά το παρελθόν υπήρξαν χώρες προέλευσης μεταναστών, πλέον αποτελούν χώρες έλξης και προσέλευσης μεταναστευτικών ροών. Σήμερα, το ζήτημα της διαχείρισης του μεταναστευτικού φαινομένου συνιστά προτεραιότητα για την Ευρωπαϊκή Ένωση, η οποία, σεβόμενη τα διαφορετικά πολιτισμικά στοιχεία, επιδιώκει να διαμορφώσει μια κοινή πολιτική, επιδιώκοντας την ένταξη των μεταναστών στην κοινωνία. Εντούτοις, υφίστανται πεδία επί των οποίων η Ευρωπαϊκή Ένωση δεν δύναται να επέμβει, καθώς τούτα εμπίπτουν στην αποκλειστική αρμοδιότητα των κρατών μελών. Τέτοιο ζήτημα συνιστά η απόδοση ιθαγένειας, η απονομή της οποίας σε πολίτες τρίτων χωρών συνιστά δημόσια πολιτική στο ευρύτερο πλαίσιο πρακτικών ένταξης. Τα κράτη μέλη προσεγγίζουν με διαφορετικό τρόπο την απόδοση της ιθαγένειας, την αναγνώριση δηλαδή της σχέσης μεταξύ κράτους και πολίτη, βασιζόμενα σε μακρόχρονες πρακτικές και το δίκαιο που διέπει κάθε κοινωνία. Στην Ελλάδα, ο νομοθέτης κλήθηκε να αντιμετωπίσει τις μαζικές μεταναστευτικές ροές και να υιοθετήσει τις κατάλληλες διατάξεις ώστε να ανταποκριθεί στις τιθέμενες ανάγκες της κοινωνίας. Η νομοθεσία που διέπει το καθεστώς των αλλοδαπών έχει υποστεί μια πληθώρα μεταβολών, αναφορικά δε με την απόδοση ιθαγένειας, αρχικά αυτή προβλέφθηκε με την πολιτογράφηση. Εν συνεχεία, καθώς κρίθηκε ως αδήριτη ανάγκη για την ένταξη η απόδοση ιθαγένειας στα παιδιά των μεταναστών, δηλαδή στους μετανάστες δεύτερης γενιάς, η πολιτεία θέσπισε διατάξεις και προχώρησε σε διοικητικές μεταρρυθμίσεις, ώστε κάτι τέτοιο να καταστεί εφικτό. Με την παρούσα επιχειρείται να εξεταστεί ο ρόλος που διαδραματίζει η απόδοση της ιθαγένειας στους μετανάστες δεύτερης γενιάς ως δημόσια πολιτική, εξετάζοντας ενδελεχώς την περίπτωση της Ελλάδας.
Abstract
Migration is a social phenomenon with a significant impact. Balances are changing, as countries that in the past have been origins of migrants are now countries of attraction of migratory flows. Today, the issue of migratory management is a priority for the European Union, which, while respecting diverse cultural elements, seeks to develop a common policy, in order to integrate immigrants into society. However, there are subjects on which the European Union cannot intervene, as these fall within the exclusive competence of the Member States. Citizenship is such an issue, the granting of which to third-country nationals constitutes a public policy in the wider context of integration practices. Each Member State approaches in a different way the matter citizenship, meaning the recognition of the relationship between the state and the citizen, based on long-standing practices and the law governing each society. In Greece, the legislator was called upon to confront the massive migratory flows and to adopt the appropriate provisions to meet the necessities of society. The legislation governing the status of aliens has undergone a multitude of changes and citizenship was granted through naturalization. Then, as the citizenship of migrant children has been a requirement, concerning their integration, the state has adopted provisions to make this possible. Here we attempt to examine the role of citizenship in second-generation migrants as a public policy, by presenting the case of Greece.
