Η νόμιμη άσκηση Υπαίθριας Διαφήμισης για εμπορικούς σκοπούς, προϋποθέτει τα σημεία και οι κατασκευές όπου θα τοποθετηθούν τα διαφημιστικά μέσα, να ανταπο-κρίνονται σε προκαθορισμένα κριτήρια. Η εργασία αναδεικνύει ασάφειες στο νομικό καθεστώς, το οποίο καλούνται να εφαρμόσουν στην Ελλάδα οι αρμόδιοι φορείς (Δήμοι και αποκεντρωμένη κρατική διοίκηση) κατά την έκδοση σχετικών κανονι-στικών αποφάσεων. Ταυτόχρονα όμως, και ανεξάρτητα των προηγούμενων ζητημά-των, αποδεικνύεται ανεπαρκής εφαρμογή της νομοθεσίας: Οι Δήμοι κατά 78% δεν έχουν ανταποκριθεί στην υποχρέωσή τους να εκδώσουν αποφάσεις με αποτέλεσμα σε αυτούς να είναι αδύνατη η διαφήμιση σε κοινόχρηστους αστικούς χώρους (πεζόδρο-μοι, πλατείες), που αποτελούν τα πλέον πρόσφορα σημεία. Αντίστοιχα, οι Αποκε-ντρωμένες Διοικήσεις δεν έχουν εκδώσει αποφάσεις σε ποσοστό 86%, και έτσι δεν είναι επίσης εφικτή η διαφήμιση κατά μήκος εθνικών οδών που δέχονται τον μεγα-λύτερο κυκλοφοριακό φόρτο. Τέλος στην εργασία, προτείνονται βελτιώσεις του νομικού πλαισίου ώστε να μειωθούν οι δυσλειτουργίες που καταγράφηκαν.
Abstract
In order that Outdoor Advertisement is carried out legally for commercial purposes, the location and infrastructure which hosts the advertisements should meet certain criteria. This dissertation describes certain the ambiguities in the Greek legal framework that public authorities (Municipalities and regional government) are required to apply during the creation of local regulations. At the same time, and independently of the aforementioned issues, there is an evident issue concerning lack of effective enforcement: 78% of Municipalities have not complied with their duty to issue regulations, rendering advertising impossible in urban public areas (commercial streets, town squares) that are the most profitable points. Similarly, 86% of the Decentralized Administrations have failed to issue regulations, also preventing advertising along heavily-used motorways that bear the most traffic. In conclusion, the present dissertation proposes several improvements to the current legal framework in order to alleviate the administrative malfunctions described.
