Σύμφωνα με την κρατούσα άποψη, τα θεμελιώδη κοινωνικά δικαιώματα ασκούνται
μόνο από πολίτες. Ωστόσο, οι περισσότερες από τις διεθνείς και ευρωπαϊκές Συμβάσεις
κατοχυρώνουν και επιβάλουν δικαιώματα και ελευθερίες που αφορούν όλους,
συμπεριλαμβανομένων των μεταναστών σε παράτυπη κατάσταση. Επίσης, τα παιδιά
χωρίς χαρτιά είναι φορείς όλων των δικαιωμάτων που εγγυάται η Σύμβαση για τα
Δικαιώματα του Παιδιού, όπως το δικαίωμα στην εκπαίδευση και στην πρόσβαση στο
σύστημα υγείας, δικαιούχοι πλήρους υγειονομικής περίθαλψης σε ισότιμη βάση με τους
ημεδαπούς. Παρόλα αυτά και παρά την ιδιαίτερα ευάλωτη θέση τους, τα παράτυπα
παιδιά των μεταναστών δικαιούνται το ίδιο επίπεδο πρόσβασης στην υγειονομική
περίθαλψη όπως οι ημεδαποί, μόνο σε τέσσερις χώρες στην Ευρώπη. Επιπρόσθετα,
παρουσιάζονται πρακτικά εμπόδια που εμποδίζουν την πρόσβαση στην υγεία και την
εκπαίδευση και χρειάζεται να αντιμετωπιστούν. Παρομοίως, το δικαίωμα στην
εκπαίδευση για τα παιδιά των μεταναστών σε παράτυπη κατάσταση, παραμένει ασαφές
σε πολλές χώρες στην Ευρώπη.
Abstract
According to the prevailing view, fundamental rights are exercised only by citizens.
However, most of International and European Conventions enshrine and enforce rights
and freedoms which are applicable to everyone, including migrants in an irregular
situation. Also, undocumented children are entitled to all the rights guaranteed by the
Convention on the Rights of the Child, such as the right to education and the access to
the healthcare system as full healthcare recipients on an equal footing with nationals.
Nevertheless, in spite of their particular vulnerability, irregular migrant children are
entitled to the same level of access to healthcare as nationals, only in four countries in
Europe. In addition, practical obstacles preventing access to healthcare and education
need to be addressed. Similarly, the right to education for irregular undocumented
migrant children remains unclear in many countries in Europe.
